Antitrust!  Are your comments compliant?

The real estate industry is very competitive and new businesses…and business models… continue to enter the market.  Make sure you don’t engage in discussions that could land you in trouble.  Making statements about practices or commission rates could fall under antitrust laws and the Code of Ethics.

One of the items that fall under antitrust compliance is that an association or individual brokerages cannot collectively set a price for services provided by real estate professionals.

When talking with consumers about fees, you must make sure that you focus on your company’s fees and do not indicate that all companies have the same rate.  And, if a question is raised about a company that charges a lower rate, you must not make any comments about their level of service or imply that other brokers won’t work with them or show their listings.

Stay positive!  Talk about your and your company’s services and marketing plans.  Encourage potential clients to compare, not only rates but benefits that each company provides to their clients.
